Introduction

These Policies & Procedures have been prepared as a guide to enhance the experience of Elamant members. All Elamant members will be required to comply with each of the following rules, guidelines, and procedures. Failure to comply with these Policies & Procedures may result in immediate termination of the membership and forfeiture of any benefits accrued.

The Elamant Membership

Elamant Member

Any person or individual (18 years of age and older) who has successfully completed the registration process in the Elamant Portal is considered an Elamant Member. With the focus on helping individuals “Become More”, our membership benefits include:

  • The Learning Center – unlimited access to thousands of exclusive industry standard hard and soft skills courses, individualized learning plans, and instructor led training. Download certifications, share or print after successful completion.
  • Personality Assessment tests – We have some of the most popular assessment tests that are available in the marketplace today. With up to 5 different tests like the Meyers Briggs and 5 Love languages, we have you covered to quickly understand more about yourself and how to connect and relate to others.
  • Podcasts and Audiobooks – Our library now contains 100’s of some of the most popular audiobooks in Leadership, Business, and Entrepreneurship. Learn from the very best in the world and take your skills to the next level to have more success in your life.
  • Global Savings Program (GSP) – With the additional Global Savings Program (GSP) benefit, Elamant members can share their accurate shopping data with us and get paid! Shop at the same retail stores, upload a proof-of-purchase receipt, and submit for validation to get savings, rewards, Elamant Keys, and even Bitcoin! Qualified members may receive up to $200 per month, saving thousands of dollars each year!
  • Mentorship Program – Our independent Mentorship program allows qualified members to earn from $20/hr to $450/hr for performing services such as mentoring, education and personal development, customer support, training, and even translation services.
  • Mastermind Coaching and Corporate Updates LIVE – Exclusive access to weekly LIVE Mastermind coaching, company news and updates with our CEO and special guest speakers.
  • Support Center – Access to our easy-to-use 24/7 ticket management system to help troubleshoot and assist with any support issue or question.

As a Member, the account will enter one or more of the following membership statuses: Active, Inactive, Suspended, or Terminated. The privileges and consequences of each membership status level are described below:

  • Active: An ”Active” membership subscription entitles the Member to individual rights, privileges, and benefits of an ”Active” membership. A member may become ”Active” by:
    • Enrolling directly as a Member with a BTC or Credit/Debit payment option
    • Renewing the Membership with BTC or Credit/Debit card, or
    • Enrolling or renewing with an Elamant Key
    • Renewing with the ARP system (see the ARP section for more information)
  • Inactive:  An “Inactive” membership status is attributed to a Member who does not currently maintain an “Active” membership subscription. A Member may only remain “Inactive” for up to 60 consecutive days before entering into “Terminated” membership status on day 61. If an “Inactive” Member renews their membership subscription, the member status will change back to “Active.”

Inactive members are not entitled to any rights, privileges, or benefits of an “Active” membership.

  • Suspended: A “Suspended” membership status applies to a Member who has had their account access temporarily revoked. A Member may enter this status from the Elamant Compliance Enforcement Team while an investigation is ongoing. A ”Suspended” Member is instantly marked “Inactive” and lose all access to the Elamant Portal and membership benefits until the investigation is complete. “Suspended” status usually only lasts a few days but usually no more than two (2) weeks until a decision is made from the Compliance Enforcement Team.
  • Terminated (Inactive): A “Terminated (Inactive)” is a member who remains “Inactive” for more than 60 consecutive days.  On the 61st day of consecutive inactive status, the Member will enter “Terminated” status. Each Terminated Member will be removed from the membership database and will no longer have any right to access or renew their membership in the Elamant Portal. All account wallet values will be cleared, and all personal information will be permanently removed from the system. If a “Terminated” Member wishes to reactivate their account, they must enroll again as a new Member.
  • Self-Termination: “Self-Termination” is when a member has opted to manually terminate their account from the member profile page. Each Terminated Member will be removed from the membership database and will no longer have any right to access or renew their membership in the Elamant Portal. All account wallet values will be cleared, and all personal information will be permanently removed from the system. If a “Terminated” Member wishes to reactivate their account, they must enroll again as a new Member.
  • Terminated (Compliance): A “Terminated (Compliance)” is a member who has been barred from the system due to a Compliance violation. All account values will be cleared, and all personal information will be permanently removed from the system. Members that have been “Terminated” from Compliance will no longer have any right to access or renew their membership in the Elamant Portal. They will also not be allowed or welcome to register or enroll again in the future.

  

 

Global Savings Program (GSP)

Overview:

With the additional Global Savings Program (GSP) benefit, Elamant members can share their accurate shopping data with us and get paid! Shop at the same retail stores, upload a proof-of-purchase receipt, and submit for validation to get GSP Cash, Elamant Keys, and even Bitcoin! Qualified members may receive up to $200 per month, saving thousands of dollars each year! As the GSP grows in more markets, even more benefits will include additional discounts and coupons from local merchants and more through our Merchant Advertising Platform (MAP)!

By collecting, organizing, and validating the shopping data from our Members, Elamant will have valuable insights on consumer shopping, purchasing habits, and even current product trends that will be useful for marketing and big data companies. Our goal is to sell advertising to local merchants where our customers shop, collect important data for potential marketing partners, and generate large revenue streams from many of the possibilities of having access to a large consumer shopping database.

NOTE: There are important restrictions and limitations in the Global Savings Program (GSP), including restrictions on Validations and receipt submission requirements. To comply with the know-your-customer (“KYC”) and other legal requirements, a Member may also be required to submit personal information, such as government identification, local tax (VAT) information, or other documents to verify personal identity before being eligible for access to use the GSP Wallet. Not ALL members will become a qualified shopper as some may not spend enough on various retail shopping each month to earn enough rewards. All current, new, and potential Elamant Members should review the rules, restrictions, and details of the Global Savings Program carefully before enrolling, promoting, and agreeing to these Policies and Procedures. Since the GSP is an additional benefit and not the main product offering with your membership, you may choose to use or opt-out at any time.

 

 

GSP Guidelines

 

Selecting Your Payment Method

With our GSP membership, our members may choose their favorite method of ‘trackable’ payment to shop with. For example, a member may choose to use the debit card that was used to purchase their Elamant membership. The GSP allows our members to select up to 2 methods of trackable payment methods that they may use to make purchases with and get approved with the GSP.  These payment methods may include, Credit/Debit card, EcoCash, Mobile Money, MTN MoMo, Vodafone Cash, AirtelTigo Money, and Mobile App Bank Transaction.

Purchases made by cash, check, or gift card/vouchers are not acceptable payment methods to use with our program at this time due to the lack of source verification.

Payment Verification

With our program, it’s important to have accurate data on our shoppers and help eliminate fraudulent submissions. One step for us to make this happen is to confirm a payment method and tie that to a specific shopper profile. There are extra rewards per receipt and Validation submitted for members that have completed this form of verification with us.

Currently, there are 3 ways of verifying your payment method.

  • At the time of enrollment or renewal with Credit/Debit card, click the box that says “Verify card for GSP”
  • If no Credit/Debit card was used at the time of enrollment or renewal, in the Shopper’s Profile click “Verify card with GSP – $10” to be taken to our merchant gateway and pay a $10 verification fee to confirm the card belongs to the shopper.
  • Purchase a “Verification Token” for $10 and paste the code in the “Verification Token” code entry box.

By verifying the payment information, a GSP member will qualify to unlock a 20% GSP Cash benefit on each receipt submitted and Validations of up to $200 per month. Without payment verification, GSP Cash is limited to 10% per receipt and up to $100 per month in approved GSP Validations.

 

Selecting Your Retail Stores

Our members may select up to 10 retail stores as part of their membership for shopping. Members may select the current retail stores that they already shop at and may add or remove a store at any time. However, once a shopping entry has been uploaded the store will ‘lock’ in place and cannot be changed until after the shopping data has been submitted for Validation. (See the section on GSP Validation)

Elamant is interested in collecting the shopping habits of retail purchases from big box retail chains, local retail stores, fuel/petrol stations, convenient stores, restaurants, and even certain online stores. (See the section labeled ‘Online Stores.’) With that in mind, most retail stores will qualify.

Even though our members may select stores they currently shop, there are some restrictions to be aware of when selecting which locations will qualify.

Service-base businesses or wholesalers that provide products at wholesale for retailers to resell will not qualify for the GSP. Types of business that will NOT qualify may include:

  • automotive repair
  • computer repair
  • chiropractic services
  • massage parlors
  • gym or fitness center memberships
  • piano lessons, etc.

NOTE: If you are paying for ‘labor’ or ‘service’ it will not qualify for the GSP unless, of course, that establishment is a member of our Merchant Advertising Platform (MAP).

  

Retail Items

Elamant defines a retail item as any physical or tangible item (not digital) purchased from a retail store and the sale from that item creates a profit for the business (non-wholesale).

Retail purchases may include:

  • electronics
  • groceries/produce
  • petrol/fuel
  • dining out (cost of food only and not including tips or gratuity)
  • prescription medication
  • clothing
  • automotive parts
  • school supplies, etc.

NOTE: Prepaid gift cards or vouchers, pre-paid credit/debit cards, fuel/petrol cards, or any other form of money/currency exchange is not considered a retail item and will not be approved at the time of Validation. Taxes added to purchase totals, such as value-added taxes (VAT), Sales Tax, or any other form of Tax, will not earn GSP Savings once Validated.

 

Online Stores

Online shopping has become more valuable for data collection and shopping habits now that many customers world-wide have quickly adopted to this form of shopping. Now, with the GSP benefit, you may choose online retail shopping that also has a physical brick and mortar store location. Online auctions, wholesalers, or stores with no physical location (like Amazon or eBay) are not valid online stores for the GSP.

 

Point-of-Sale Receipts / Slips

After the sale of a retail item from a retail store it is customary to receive a proof of purchase in the form of a receipt or sales slip. Some will be printed out on paper while others may opt for a digital receipt that usually gets emailed. This Proof of Purchase holds information about the transaction such as the accurate date, location, retail store name, total amount spent, items purchased, method of payment, etc. A physical shopping record (POS receipt/slip), along with additional information manually entered (categories, type of currency used, etc), will allow us to correctly process this shopping experience into usable data. A receipt that is handwritten will not qualify.

IMPORTANT NOTE: An individual shopping receipt or slip may only be uploaded and submitted once. Sharing a shopping receipt/slip for others to upload and collect benefits from Elamant will be detected by our software and both submissions will be declined at the time of Validation and the member may be subject to suspension from our program or terminated.

Point-of-Sale Totals

Elamant is looking for buying habits of retail consumers. To ensure we collect this type of data, all purchases must be within an acceptable range to be eligible for GSP Validation. Each retail receipt must have a subtotal no less than $5.00 USD and no more than $200.00 USD subtotal per receipt. ANY retail receipt with a subtotal over $200.00 USD can not be submitted for Validation with the GSP.

Currency Conversion Tool

Our software links with “Real-Time” currency exchanges to determine the best rate at the time of conversion. If a member is using a currency other than USD, the currency conversion tool will automatically convert the currency into a USD value. For example, if purchases are made in South African Rand (ZAR), then the member will enter their shopping data exactly with what is one the receipt in the values of ZAR. Our software will then convert the currency automatically without any further action from the member. 

 

Submitting a GSP Validation

The GSP Member may submit a request to redeem submitted receipts for GSP Cash to be deposited into the GSP Wallet (a “Validation”) every thirty (30) days or thirty (30) days from the last redemption submitted.

Note: The first Validation will only be available thirty (30) days from when the Member has completed the required registration in the Shopper’s Profile. If the membership was activated on January 1st, but the Shopper’s Profile registration wasn’t completed until January 15th, then the first Validation of shopping will not be available until February 14th)

On the date that the GSP receipts are submitted for Validation, it will be in processing for 60 days. On the 61st day, if approved, the total amount submitted for Validation will be immediately deposited into the GSP Wallet instant use. To make the understanding of our process clear, the Member has 30 days of shopping and then 60 days of processing and Validation for the database to filter, approve, and process these buying habits. If a Member is submitting their shopping receipts every 30 days for Validation, the Member may receive GSP Cash into their GSP Wallet every month after the first 90 days.

 

Receipts determined to be fraudulent or edited in any fashion will not be approved, and individual may be suspended or terminated and subject to legal action.

 

Understanding GSP Savings and GSP Cash

There are two types of values that Elamant will assign submitted receipt data. GSP Savings are calculated and accumulated at the end of each shopping week (Sunday through Saturday), and GSP Cash is the resulting rewards deposited into the GSP Wallet after an approved GSP Validation. GSP Savings has no cash value and are only for visual accumulation towards a Validation.

 

GSP Validation Limits

To ensure that you achieve the maximum GSP Savings every week, you must submit receipts with a combined subtotal of at least $200.00 USD for qualified members with an approved Payment Verification or $400.00 USD in shopping receipts for all other members. This will allow the maximum of 40 GSP Savings to be earned each week. A Member may be allowed to submit an unlimited amount of receipts per week, however, a Member cannot accrue benefits for any receipts submitted more than the maximum allowable GSP Savings (40) for that week.

Once a member submits the maximum of allowed GSP Savings per week (40) for 4 consecutive weeks (totaling 160), then the member may request for 100 of the 160 GSP Savings to be submitted leaving 60 GSP Savings to rollover to be added to next month Validation.

Each GSP Validation may only be redeemed for $100 in GSP Cash or $200 in GSP Cash if the member has an approved Payment Verification. A Verification may only be submitted after 4 full weeks of shopping (every 30 days) or once the GSP Savings has accumulated to at least 100 if it has been over 30 days without Validation.

NOTE: The first GSP Validation can only be redeemed for $100 GSP Cash. A member may redeem up to $200 for every month after if the Validations are approved, the Payment Verification method is approved, and the member is maximizing their GSP receipts every week.

 

GSP Savings Rollover

If the total number of GSP Savings exceeds the maximum for a GSP Validation, then the unused GSP Savings will be automatically saved and ‘rolled over’ to be used towards the next Validation. Considering the maximum amount of GSP Savings a member may earn per week is 40, this would accumulate a total of 160 in the first month (30 days). The Member would then be allowed to submit a Verification for $100 GSP Cash each month, and the remaining 60 GSP Savings would be ‘rolled over’ and added to the next Verification.

 

Refund Policy

A first-time Elamant Member may cancel their membership for ANY reason within 72 hours (3 days) (if paid with a Credit/Debit card through our merchant provider) and receive a full refund to the Credit/Debit card used to complete the membership purchase.* 

Elamant Keys that are manually transferred from one account to another are not refundable or reversable. Please be sure you are sending the Elamant Key to the right account before transferring.

*The refund guarantee applies to new membership enrollments paid by credit/debit card only. Once the refund is processed, the system will terminate the membership. There are no refunds if payment is made using Bitcoin (BTC) or other forms of cryptocurrency. There are also no refunds or exchanges on Elamant Keys. All bulk order sales of Elamant Keys paid to the company are final.

 

Member Code of Conduct

When speaking of the company, enrolling new Members, dealing with current or potential Elamant Members, all Members are expected to exercise due care and diligence to represent themselves and Elamant in full compliance with the Company brand, image, and Policies and Procedures. Above all, a Member should never lie or misrepresent themselves, their role, or Elamant and its programs to the public or potential Members. When undertaking any of these activities, all Members must ensure they adhere to the following guidelines:

  1. All Members are independent representatives of the company, which does not create an employer/employee relationship, agency, partnership, or joint venture between the company and the Members. Each Member shall hold harmless the company from any claims, damages, or liabilities arising out of Member’s business practices. Company Members have no authority to bind the company to any obligation. All actions conducted by Members are in the capacity of an independent third party.
  1. In the conduct of its business, the Member shall safeguard and promote the reputation of the services of the company and shall refrain from all conduct which might be harmful to such reputation of the company or the marketing of such services or inconsistent with the public interest, and shall avoid all discourteous, deceptive, misleading, unethical or immoral conduct or practices. A Member shall not interfere with, harass, or undermine other Members and, at all times, shall respect the privacy of other Members. A Member must not disparage the Company, its affiliated entities, other Company Members, Company products and/or services, the marketing, compensation and reward plans, or Company employees.
  1. All Members are responsible for paying applicable local, state, and national taxes on bonuses, rewards, rebates, or any other earnings generated as a referee of Company memberships, products, and services. All Members are responsible for abiding by their home country’s local, state, and national laws and regulations.
  1. Company Members shall not advertise Company products and services and/or marketing plans except as specifically approved by the company. Company Members agree to make no false or fraudulent representations about the company, the products, the Company compensation plan, or income potentials.
  1. The company maintains official corporate websites, social media pages, online groups and forums (such as, but not limited to, Facebook Groups), and smartphone applications (collectively the “Elamant Portal”). No Member may independently design or establish a website, social media page/group, app, or other portal or service of any type whatsoever that uses the names, logos, product or service descriptions of the company, nor may a Member use “blind” ads on the Internet making product or income claims which are ultimately associated with Company products, services, or the company’s compensation plan without prior Company approval. However, Members may participate in social networking over the Internet to promote the company’s products and rewards, in full accordance with Company policies and procedures. Any person using Company names, logos, trademarks, etc., on the Internet or any other advertising medium, except as permitted by Company rules and regulations, shall be subject to immediate discipline, including but not limited to termination of Member
  1. The company reserves the right to approve or disapprove Member’s change of name, business name, or organizational form associated with the Member’s registration. If the company approves such a change by the Member, the organization’s name, and the organization’s principals’ names must appear on the Member application/agreement and a national identification number of each. The Member prohibited to make changes to circumvent or violate Company rules on raiding, solicitation, targeting, cross-sponsoring, or interference.
  1. If a Member fails to maintain the recurring 28-day payment for membership, the membership will assume Inactive status and lose some rights, privileges, and other accrued benefits. If a Member remains Inactive for more than 60 days, the membership will enter Terminated status, and all rights to bonuses, member benefits, and access to Membership Portal will permanently cease.
  1. The company shall be entitled to change membership prices, the Mentorship compensation plan, or GSP reward program at any time and without notice, and to make changes effective as needed for publication on the Company website.
  1. Periodically, the company will supply data processing information and reports to the Member, which will provide information concerning the Member’s referrals. The Member agrees that such information is proprietary and confidential to the company and is transmitted to the Member in confidence. The Member agrees that he or she will not disclose such information to any third party directly or indirectly, nor use the information to compete with the company directly or indirectly during or after the term of the agreement.
  1. The company expressly reserves the right to alter or amend prices, fees, the Terms of Use, the Policies and Procedures, Member benefits and terms, reward programs, compensation plans, or any other rules or regulations set by the company at any time.
  1. Members may not advertise any Elamant products/services at a price LESS than the highest company published, established retail price of ONE offering of the Elamant product or service. No special enticement advertising is allowed. This includes, but is not limited to, offers of free memberships or other offers that grant advantage beyond those available through the company. Members or Mentors found to violate this policy may be terminated immediately without review.
  1. The acceptance of these terms, policies, and procedures does not constitute the sale of a franchise, and no exclusive territories will be granted to anyone. No franchise fees have been paid, nor will any member acquire any interest in a security by accepting these agreements.
  1. Members shall maintain the highest standards of business practices when discussing or marketing Elamant. Members shall refrain from engaging in unethical business practices or violating standards of fair dealing, engaging in cross-team recruiting or other unfair or unethical business practices, or generally engaging in any activities that would damage the company’s brand (in its sole discretion).
  1. Members may not make claims or warranties of any kind, including, but not limited to, any claims for earnings or services, other than those included in company written literature.
  1. Sending SPAM, also known as Unsolicited Commercial Email (UCE), is prohibited by the company. Any use of SPAM, fax broadcasting, automated messaging, or automated telemarketing by phone in connection with the company’s business may result in suspension, a fine, or termination of membership.

Trademark, Trade Names, Advertising

The company’s name and other names as may be adopted by the company are proprietary trade names and trademarks of the company. As such, these marks are of great value to the company and are supplied to the Member for Member’s use only in an expressly authorized manner.

  1. Member agrees not to advertise the Company products or services in any way other than the advertising or promotional materials made available to Member by the Company. Member agrees not to use any written, printed, recorded, digital or any other material in advertising, promoting or describing the products or services or the Company marketing program, or in any other manner, any material which has not been copyrighted and supplied by the company, unless such material has been submitted to the company and approved in writing by the company before being disseminated, published or displayed.
  1. The Member, as an independent third party, is fully responsible for all of his/her verbal and written statements made regarding the product or service and marketing program, which are not expressly contained in writing in the current Member Agreement, and advertising or promotional materials supplied directly by the company. Member agrees to indemnify the company and hold it harmless from any and all liability including judgments, civil penalties, refund, attorney fees, court costs, or lost business incurred by the company due to Member’s unauthorized representations.
  1. All Company materials, whether printed, on film, produced by sound recording, in digital media format or on the Internet, and social media of any type, are copyrighted and may not be reproduced in whole or in part by Members or any other person except as authorized by the company.
  1. A Member may not produce, use, or distribute any information relative to the contents, characteristics, or properties of the Company product or service which has not been provided directly by the company. This prohibition includes, but is not limited to, print, audio, video, or other digital media.
  1. All advertising copy, direct mailing, email, radio, TV, newspaper, and display copy via the Internet must be approved in writing before being disseminated, published, or displayed except for blind ads where no reference is made to the Company name or product name.
  1. Members may not register or claim ownership of any trademarks, logo, or any other intellectual property of the company in any jurisdiction in the world.

Individual and Entity Ownership Information

Membership accounts may only be owned and held by individuals, not corporations or other entities, without the company’s express approval. An individual shall provide the company with a National Identification Number and other documents as required to verify identity through the KYC process ordained by the Company. No individual operating under a fictitious name may become a Member. If any entity other than an individual wish to become a Member, the individual(s) controlling the partnership, corporation, or other business entity is required to fulfill the same requirements as all individuals under this agreement.

All Elamant Members agree to:

  1. Provide information, support, and training to the Members personally sponsored.
  2. Study the company literature and learn to represent the company and services honestly and sincerely.
  3. Help other Members directly connect with top leaders and Mentors.
  4. Be professional, courteous, and considerate.
  5. Not misrepresent the Mentorship Program or any other Elamant service or benefit.
  6. Become familiar with and abide by other materials as provided by the company.
  7. Not treat access to the membership as a business opportunity, investment, or other vehicles for financial gain, nor create a network of referrals through techniques such as “stacking,” creating fake entities, submitting fake or inaccurate shopping data, or any other such activity – undertaken individually or in concert with others – contrary to the company purpose and its Policies and Procedures.

 

 

Disciplinary Actions, Termination, and Appeals

 

Disciplinary Actions

Elamant generally reserves the right to terminate any Member’s account for any reason and without notice. However, Elamant may in its sole discretion choose to take any of the following disciplinary actions regarding a Member’s violation of these Policies and Procedures, the Terms of Use, or any other rules, agreements, or policies put in place by Elamant:

  1. Issuance of a written warning or admonition.
  2. The imposition of a fine, which may be imposed immediately or withheld from future bonuses, rewards, rebates, or other vehicles as deemed available by the company.
  3. Loss of benefits related to Member referrals and compensation or removal from the Mentorship Program.
  4. Suspension, which may result in termination or reinstatement with conditions or restrictions.
  5. Termination of the Membership.

 

Termination Procedure & Appeals

When a decision is made to terminate a Member, the company will inform the Member that the Member is terminated immediately, effective as of the notification date. The Member will have 15 days from the date of notification to appeal the termination in writing to compliance@elamant.com, and therein provide a written response to the finding of violations of Company Agreement, policies, and/or rules. If the appeal is not received within 15 days, the termination will be automatically deemed final.

If a Member files a timely appeal of termination, the company will review and reconsider the termination, consider any other appropriate action, and notify the Member of its decision. The decision of the company will be final and subject to no further review. If the termination is not rescinded, the termination will be effective as of the date of the company’s original termination notice.

Once a preliminary decision to terminate a Member’s account has been made, the Member in question shall thereafter be prohibited from using the names, marks or signs, labels, stationery, advertising, or business material referring to or relating to any Company products or services. The terminated Member shall not represent themselves as an Elamant Member. During the pendency of any appeal, the Member must not take any action to violate this or any other provision of the Members’ Policies & Procedures or the Terms of Use, or the pending appeal will automatically be terminated.

 

 

The Elamant Opportunity

 

Elamant has adopted a unique and innovative 2-step opportunity for all members. This program enables Members to earn a Free Membership for referring 3 Members and earn hourly compensation for the services they provide for the company. The Elamant Opportunity is comprised of two steps: the Founder Program and the Mentorship Program.

 

Step 1: Founder Program

Members will be rewarded with a FREE membership by personally sponsoring individuals to join Elamant as an “Active” Member.

How to Qualify for Founder:
  1. Must be an Active Member
  2. Personally sponsor a minimum of three (3) other “Active” Members

At the time of renewal, the Founder will automatically have their membership extended 28 days. A Founder may continue have a Free membership every membership cycle that they remain a qualified Founder. If, at the time of renewal, the Member is no longer qualified as a Founder (with 3 active members personally sponsored), the system will run the “ARP” (See below) before changing the status to “Inactive.”

Automatic Renewal Program (ARP)

At the time of renewal, the system will run a series of programs to check whether the account should be marked as “Active” or “Inactive.” This is a huge benefit to our members that may have funds in their Ewallet or an unused Elamant Key.

In order, the series of system programs that run are as follows:

  • Founder qualification check. If the account qualifies as Founder, the system will extend the account 28 more days. If the account does not qualify for Founder, it will then check the next item.
  • Ewallet balance check. If the Ewallet has at least $97 in the account, the system will deduct that amount and extend the account 28 more days. If the Ewallet does not have enough funds, it will then check the next item.
  • Unused Elamant Key. If there is an unused Elamant Key in their Elamant Keychain account, the system will deduct the unused Key and extend the account 28 more days. If there are no unused Elamant Keys available, then the system will mark the account as “Inactive.”

NOTE: To maintain Founder, it is not required that new members are personally sponsored. The same 3 original personally sponsored “Active” members may continue to qualify the sponsor for Founder every month that they continue to renew their accounts.

  

Step 2: Mentorship Program

One of the key goals of Elamant is to provide our Members with the opportunity for professional growth and development. This has the benefit of turning our Members into a skilled pool of professionals and allows Elamant to run as a distributed company, like many new firms in the “gig” economy (Gig workers are independent contractors, online platform workers, contract firm workers, on-call workers, and temporary workers. Gig workers enter into formal agreements with on-demand companies to provide services to the company’s clients). As the Elamant network grows, there is opportunity for Members to become Mentors and directly provide essential services and support to Elamant Members and Elamant directly.

As Elamant Mentors take on more responsibility, sponsor more Members, and see their team grow, they qualify for different Service Levels of engagement as a Mentor. The Service Level determines both the hourly rate Elamant will pay the Mentor for work performance and the total volume of work eligible to the Mentor for assignment (i.e. hours per week).

Note: Learn more about each Service Level’s compensation structure, as well as the qualification requirements, below under “Mentor Service Levels.”

As a Mentor, a variety of tasks and obligations can be assigned. Some examples of the type of work assigned to Mentors include:

  • Mentoring and Training. Elamant tasks its Mentors with ensuring that Elamant Members fully understand Elamant’s programs, systems, interface, and rules. This could include training new Members on correctly navigating the Elamant Learning system and showing them how to start their pre-assessment to ensure they have courses that fit their current skill level and learning needs. Mentors at higher Service Levels, or who have received additional specialized training, may also train other Mentors in their duties.
  • Customer and Member Support. Rather than maintain a large customer support staff, Elamant Mentors act as the primary support for Members with questions, concerns, or issues relating to their Elamant Membership.
  • Continuous Education. By completing leadership and professional development training courses through our Business Center, a Mentor may claim these hours for compensation based on our compensation chart.
  • Translation and local language support. Elamant has Members worldwide, and we rely on our local Mentors to help with everything from translating Company materials and documents to providing customer support to non-English speakers.

Additional Duties and Obligations at Increased Service Level

 

Elamant Opportunity Exclusivity

As part of Mentor duties, beginning as a Manager-level Mentor, you will routinely interact with and support the Elamant members on your team. You will also take on greater responsibility, with more members to support and a higher expectation of your knowledge and ability to teach your team.  This gives you the opportunity to learn and demonstrate the leadership skills we aim to cultivate. In doing so, you will form a bond of trust with your team members. While this is a crucial relationship to build, the global distribution of Elamant members and Mentors creates certain risks we must address. We must ensure that high-level Mentors do not abuse this bond of trust and make the appropriate time commitments to their duties.

For these reasons, beginning at a Manager-level Mentor, you must agree not to engage in any kind of promotion or solicitation on behalf of any network marketing business or otherwise support or work on behalf of the same. This means that you cannot promote or receive any type of compensation whatsoever – whether directly or on your behalf – from any business which provides compensation based in whole or part, directly or by secondary reference, upon sales, referrals, recruitment, promotion, or other such activity.

As a reminder, NO Mentor should be promoting other such opportunities to Elamant members, regardless of their service level.

Ex.1: Mentor A works for an auto dealer and sells cars based upon commission. Mentor A can be eligible for the Manager level.

Ex.2: Mentor B works for an auto dealer and recruits or hires a team to sell cars. Mentor B makes money based on the commissions of his team or recruits. Mentor B is not eligible for the Manager level.

 

Changes to or Transfers of Mentor Positions

Members may request a change of ownership information on their Elamant account, subject to Elamant’s approval and sole discretion. Commonly approved reasons include transferring an account to a decedent, undergoing a change in business type, or other administrative needs. Elamant reserves the right to approve or disapprove any and all transfers of Member accounts, positions, and benefits, but we will generally do so if there is no risk of fraud or harm or if the request is merely to correct an administrative error.  All such transfers will be contingent upon receipt of a signed waiver of liability by the former Member.

However, if an account change or transfer is approved, Mentor Levels associated with a Member’s account do NOT automatically transfer to the new Member. Mentors’ compensation rates at each level reflect that Mentor’s skills, time spent, and value to the company. For this reason, we do not generally permit the transfer – through a sale or otherwise – of Elamant Mentor positions.

Under certain circumstances, Elamant may make exceptions for such transfers or substitutions for Mentor Levels and positions. For example, if you’ve built a business with an Elamant component and you are getting ready to retire, then you may wish to sell your business or transfer it to your heirs. Subject to our due diligence, including proof of a bona fide sale or transfer of a whole business, we may be willing to approve an attendant transfer of the associated Mentor Service Level and position to the new owner. Factors we may assess in deciding whether to permit a transfer include:

  • Demonstration of the qualifications and capabilities of the proposed transferee for the relevant Mentor Service Level.
  • Harm or impact on the transferor.
  • The legal or commercial risk to Elamant.
  • Evidence of a bona fide business sale; for example, the concurrent sale of other assets or rights by the transferor at the same time as the proposed Mentor position transfer.

If your transfer is approved, you will be charged a service and processing fee to cover the costs of our own due diligence and other related items. The fee charged will depend upon the risk and complexity of the transfer to Elamant and will be determined and disclosed to you prior to any approval for a transfer.

Ultimately, although your Service Level is a reward for your work and achievements with Elamant, being an Elamant Mentor is a privilege, not an asset. You should never rely upon an anticipated sale of your position.

Submitting Hours & Redeeming Payments

 

Tracking & Submitting Service Hours

Mentors are only paid for the actual hours they work, train, study, and attend Elamant events/meetings. You must carefully track your time with our time entry software with a minimum of one hour. In your time log, each time entry should be followed by a summary description of your activities at that time. As an Elamant Mentor, you have broad latitude in determining what, when, and how you work and are even encouraged to source and develop your hours. As a consequence, we need to be able to prevent fraud or misbehavior by Mentors remotely. This means that your log should have sufficient details on your activities during each period to allow us to verify you did the work. Mentors may be required to submit their complete-time logs, as well as answer questions or provide other supporting evidence of work performed.

Mentors must submit their time entries through the Elamant time entry software by the end of each week (Saturday 11:59PM CST). The information in the comments submitted for each time ticket should correlate to the log details. Once all time entries have been submitted from the ‘performance period’, the entries will show as “pending” until they are either denied or approved by Elamant (see Approval Process, below).

Approval Process

To ensure that Mentors are doing valid and quality work consistently, each time ticket submission will be reviewed before being approved for payment. Elamant reserves the right to reject any time submission. Reasons a time submission may be rejected include:

  • Incomplete submissions. For example, failure to provide sufficient details in the comment to a time ticket may result in denial.
  • Indication of fraud. Work must have been performed to the satisfaction of the approval process to qualify for payment. Submitting a short, effortless description without detail, Spamming (copying) the same response over and over for each entry, or any other fraudulent or misrepresentation of activity determined by the company may also result in declining the entire week of submitted hours
  • Late submissions. Failure to upload a time ticket within the ‘Performance Period’ (See Elamant Company Definitions and Terms at the bottom section of this document) may result in that time entry being denied.
  • Sale, Marketing, Recruiting, or Advertising. Service hours submitted for approval that includes time spent selling memberships, recruiting new members (other than new Merchants or Travel customers) will not be approved.

Elamant reserves the right to audit, investigate, and question any hours that have been submitted for approval. In addition to denial of the time tickets, some severe or repeat cases may be referred to our Compliance Department for further action, including, but not limited to Removal from Mentor Program, Membership Suspension, Termination, and/or a fine.

If you believe one of your time tickets was denied incorrectly, you may appeal the decision through the normal Company appeals process by first sending an email to compliance@elamant.com. Be sure to include any evidence or explanation supporting your position. Your submission may be independently reviewed through secondary validation processes, along with any supporting evidence or documentation you provide in your email regarding the validity of your time submission. Evidence might include specific work products, travel receipts to an event, additional details regarding your activities, or an explanation of the second reviewer’s discrepancies.

 

EWallet

This is the account to which all approved hourly service compensation and other bonuses are deposited. The funds in this account are non-transferable to any other member account directly but funds in the Ewallet may be used or withdrawn at anytime in the form of an Elamant Key (in $97 increments) and weekly to the verified external BTC wallet on file.

The funds in this wallet can be in one of two statuses: the “Approved” status and the “Pending” status.

Pending:

Hours submitted from the “Time Report” during the Performance Period (Sunday – Saturday) are placed in the “Pending” section of the Ewallet account for 1 week. The following Sunday, if approved, the funds will be released from “Pending” status and will be automatically deposited into the “Approved” section of the Ewallet and be ready for immediate use. The total history of all amounts, deposits, and withdrawals will be visible to each Mentor and Founder in the Ewallet menu item page of the Elamant Portal.

IMPORTANT NOTICE: There are important restrictions and limitations on any Ewallet withdrawals, including restrictions on external BTC withdrawals. To comply with the know-your-customer (“KYC”) and other legal requirements, Founders and Mentors WILL be required to submit personal information, such as government identification, local tax (VAT) information, or other documents to verify identity before being eligible for any single withdrawal over $1,000 or combined withdrawals totaling more than $10,000 annually, whichever instance occurs first. Members should review the Independent Mentorship Agreement carefully to understand what is required BEFORE becoming a Mentor.

Terms & Conditions for BTC Withdrawals

The Ewallet account holder may request to withdraw into their external BTC wallet at any time. The processing will be processed every Monday by 5pm CST.

To qualify for a BTC withdrawal, a Member or Mentor must meet or abide by the following terms and conditions. All crypto payments will be made in Bitcoin (BTC).

  • Member must be an ACTIVE Member – If a withdrawal request is pending or if the membership goes inactive, terminated, or suspended before the day of processing, the transaction will be canceled and funds credited back to the members’ Ewallet with a $10 fee added.
  • A withdrawal request may be submitted at any time, but payout processing occurs every Monday. The BTC withdrawal request will be processed by 5pm USA (Central Standard Time / GMT -6) on Monday of every week.
  • There may only be 1 withdrawal request submitted at a time.
  • The minimum withdrawal amount for a BTC withdrawal request is $100.00 and in increments of $100.00. For example, if there is $327.00 in the Ewallet, you may only be eligible to request $300.00 USD for a BTC withdrawal.
  • A transaction fee of $5.00 USD will apply to each withdrawal
  • An additional 2% service and processing fee will apply for each withdrawal
  • The Member MUST have correctly completed and passed KYC validation before the BTC withdrawal request of over $1,000 at once or $10,000 per year processed.
  • The maximum withdrawal amount per week allotted depends on the qualified service level of the Member or Mentor. (Please see “Weekly Withdrawal Limits By Service Level” below for more information.)

Mentorship Service Levels

By training, educating, and supporting the growing network of Elamant Members, Mentors may qualify to receive hourly compensation. With our Exclusive Mentorship Program, Mentors are paid for the services they provide for the company and compensated at an hourly rate.

The estimated weekly and yearly incomes provided below are based upon the assumption that the Mentor completes and submits the maximum number of hours per week, and all work submitted is valid and accepted via the approval process. Mentors are ultimately responsible for their work, hours, and earnings. Elamant makes no guarantee that a Mentor will be able to accrue enough good work hours to achieve the listed estimated incomes, or any income whatsoever.

DEFINITIONS AND TERMS

Any dispute, misunderstanding, confusion, or misinterpretation that arises in any material or content provided by Elamant (or in any of the translated documents) will be determined by Elamant in the officially recognized English language, in its sole and absolute discretion, including without limitation:

  • Actual Hours – Refers to the number of hours actually worked and recorded by each Mentor during a Performance Period, which shall not exceed the number of Allocated Hours for such Performance Period.

 

  • Allocated Hours – The total number of hours allotted for each Mentor to provide service work and claim in any given Performance Period.

 

  • Mentor – A Member that meets the Service Level requirements of a Mentor and qualifies to earn an hourly rate of pay based on the approved services provided by the Mentor to Elamant in accordance with the Independent Mentorship Agreement.

 

  • Elamant Portal – The software that allows Member access to all the various services that Elamant and its third-party affiliates provide through its member websites https://elamant.com or https://portal.elamant.com, related mobile application(s), and related services are collectively defined as the “Elamant Portal”.

 

  • Elamant KEY – An encrypted, unique digital code that is used for the purpose of activating or renewing a membership. The Elamant KEY (aka Pass or Code) will extend a membership for 28 days. The customer will have access to all membership benefits. This code may be purchased directly from the company with one of the approved Payment Options or generated at any time from the Ewallet, providing there are enough funds.
  • Ewallet – This is the account to which all approved hourly service fees and bonuses are deposited. This account is made up of two (2) parts: the “Approved” status and the “Pending” status. The funds in this account are non-transferable to any other member Ewallet account. E-wallet funds may be withdrawn weekly in Bitcoin (BTC) to the account holders’ registered Bitcoin Wallet or withdrawn at anytime in increments of $97 for an Elamant KEY.

 

  • Founder – Any Member that has personally enrolled three (3) other “Active” Members (aka: Personal Referrals)

 

  • GSP – Global Savings Program

 

  • GSP Cash – the resulting rewards deposited into the GSP Wallet after an approved GSP Validation.

 

  • GSP Savings – The units of receipt credits are calculated and accumulated at the end of each shopping week (maximum of 40 per week) that can be submitted for Validation every 30 days for $100 or $200 in GSP Cash.

 

  • GSP Wallet – This is the account to which all approved GSP Validations are deposited. This account is made up of two (2) parts: the “Approved” status and the “Pending” status. The funds in this account are non-transferable to other wallets or any other member. Funds in the GSP Wallet may be withdrawn weekly in Bitcoin (BTC) to the account holders’ registered Bitcoin Wallet or withdrawn at anytime in increments of $97 for an Elamant KEY.

 

  • GSP Validation – The 60-day process that allows GSP Savings to be converted, if approved, into GSP Cash and deposited into the GSP Wallet.

 

 

  • Hourly Rate – An amount payable to each Mentor for providing at least one hour of support, education, online or offline training, or other beneficial services to Elamant Team Members. Elamant determines the value of the hourly rate based on the Mentor’s experience, workload, expertise, and Service Level. The hourly rate ranges from $20 USD per hour and up.
  • KYC – Know Your Customer (KYC) is the aspect of due diligence that deals with the precise identification of customers. It may involve submitting personal information like a national ID, passport, proof of residence, and others for the purposes of validating customer identity.

 

  • MAP – Merchant Advertising Program

 

  • Membership Cycle – One (1) complete Membership Cycle is equivalent to 28 consecutive calendar days. A membership may be purchased in either one (1) cycle, three (3) cycles, or thirteen (13) (treated by Elamant as one (1) year) cycle increments.

 

  • Online Stores – Now, with the GSP benefit, you may choose online retail shopping that also has a physical brick and mortar store location. Online auctions, wholesalers, or stores with no physical location (like Amazon or eBay) are not valid online stores for the GSP.
  • Payment Options – Members can pay for their membership with a Credit/Debit card, Bitcoin (BTC), or Elamant KEY
  • Performance Period – The “Performance Period” is a calendar week from Sunday to Saturday, beginning on Sunday at 00:00 am Central Standard Time (CST) and ending Saturday at 11:59 pm Central Standard Time (CST)

 

  • Personal Referral – A Member who was personally enrolled by a “Sponsor.”
  • Retail Items – Elamant defines a retail item as any physical or tangible item (not digital) purchased from a retail store and the sale from that item creates a profit for the business (non-wholesale).

 

  • Retail StoreBig box retail chains, local retail stores, fuel/petrol stations, convenient stores, restaurants, and even certain online stores would be considered a Retail Store. Service-base businesses or wholesalers that provide products at wholesale for retailers to resell are not considered Retail Stores.
  • Service Level – The rank or position at which the Mentor qualifies during any given Performance Period.

 

  • Server Time – Central Standard Time (CST) is the official time zone that the company software and system operate in.

 

  • Sponsor – A Member who has made at least one Personal Referral.

 

  • Team – A group of Members associated with each individual Personal Referral consisting of any and all Team Members of all such Personal Referrals. Each Personal Referral will begin a new and separate team.
